If you are unsure what a conveyancer is and what they do, here is a brief overview.
What is conveyancing?
When a property transaction takes place, the land ownership is transferred from one person or entity to another. Conveyancing is a legal process used to execute these transfers. Both buyers and sellers require a conveyancer or solicitor to guide them through the process.A conveyancer generally provides the following services:
- Search and confirm the Certificate of Title
- Review the Contract of Sale or purchase
- Complete and execute the documents to facilitate the buy or sell transaction
- Communicate the transaction with the buyer’s or vendor’s conveyancer, depending on who they are acting for
- Assess and review the mortgage contract
- Manage the settlement booking with the bank and other parties involved
- Process the stamp duty payment
- Adjust any necessary rates and taxes
- Calculate and determine the Statement of Adjustments
- Complete the settlement on your behalf
What helps determine a good conveyancer?
There are many great conveyancers, but to ensure you meet the right one, here are a few questions you may want to ask:- Are you a member of the Australian Institute of Conveyancers?
- How long have you been a conveyancer?
- What type of property do you specialise in?
- Do you know how to process off the plan settlements?
- Can you review our Contract of Sale? (This helps you learn how well they know property law)
- What are the fees and charges and what services do they cover? (cheap doesn’t mean better, but you want to know if there are any additional costs in advance)
- How will you service me and when do we need to talk?
